Welcome to the House of Montague. These Terms of Service govern your access to and use of tcmontague.com, including its artwork listings, editorial content, design studies, audio, video, customer accounts, acquisition services, and related features collectively referred to as the “Services.”

The Services are operated by Terry Christopher Montague under the trade name TC Montague and the House of Montague brand. Throughout these Terms, the words “House of Montague,” “the House,” “we,” “us,” and “our” refer to Terry Christopher Montague and TC Montague.

Our online commerce platform is provided by Shopify, which enables us to present and sell artworks through the Services.

Please read these Terms carefully. By visiting, browsing, creating an account, submitting an inquiry, or completing an acquisition through the Services, you agree to be bound by these Terms and the policies incorporated into them.

1. Acceptance of These Terms

By accessing or using the Services, you confirm that you have read, understood, and agreed to these Terms of Service together with our Privacy Policy , Returns & Refunds Policy , and Shipping & Delivery Policy .

If you do not agree to these Terms or the incorporated policies, you must not use the Services.


2. Eligibility, Accounts & Information

You must be at least the age of majority in your state, province, or country of residence to complete an acquisition. By permitting a minor to use a device or account under your control, you accept responsibility for that activity.

You agree to provide current, complete, and accurate billing, payment, delivery, and contact information. You are responsible for maintaining the confidentiality of any account credentials and for activity conducted through your account.

You may not transfer, sell, assign, or license your customer account to another person. Please notify us promptly if you believe an account has been accessed without authorization.


3. Artwork Descriptions & Visual Representation

We make every reasonable effort to present each artwork, its dimensions, orientation, material, edition status, border, and presentation accurately. Minor differences may occur between the artwork as displayed on a screen and the physical work because of monitor calibration, device settings, ambient lighting, material reflectivity, and the characteristics of photographic production.

Styled interiors, room scenes, design studies, scale guides, detail views, videos, and related imagery are provided to assist with interpretation, placement, and presentation. Unless expressly stated otherwise, frames, matting, furniture, lighting, decorative objects, architectural elements, and other surroundings shown in these materials are not included with the acquisition.

Artworks are supplied unframed unless the applicable artwork page expressly states otherwise. The dimensions, material, and presentation selected at checkout form part of the confirmed acquisition specifications.

We may refine descriptions, imagery, available dimensions, or presentation information when necessary for accuracy. Such changes will not alter an already accepted acquisition without the collector’s agreement.


4. Orders & Acquisition Acceptance

Submitting an order constitutes an offer to acquire the selected artwork. An automated order acknowledgement confirms receipt but does not by itself guarantee acceptance.

An acquisition is accepted when payment has been successfully authorized and we confirm the acquisition or begin production. We reserve the right to decline or cancel an order for legitimate reasons, including suspected fraud, payment failure, material pricing or listing errors, production unavailability, delivery restrictions, or legal and regulatory requirements.

If an order is declined or cancelled before fulfillment after payment has been collected, the applicable amount will be returned to the original payment method.

Please review the selected artwork, dimensions, orientation, material, border, delivery information, and contact details carefully before submitting an order.


5. Edition Status, Studio Archive & Certificate of Authenticity

The edition status of each artwork is stated on its applicable artwork page. Unless expressly identified as a limited edition, the assignment of an archive number does not represent a fixed edition size or a claim of scarcity.

Each confirmed acquisition is registered within the House of Montague studio archive and assigned an individual archive number. A digitally signed Certificate of Authenticity is prepared for the acquisition and delivered with or in connection with the artwork.

The archive record and Certificate of Authenticity document authorship, acquisition specifications, and provenance. They do not transfer copyright, reproduction rights, or other intellectual-property rights in the artwork.

When an artwork is replaced following verified damage, loss, production defect, or fulfillment error, the replacement remains linked to the original acquisition record. The studio archive will document the replacement, and any certificate associated with the compromised or incorrect artwork will be superseded.


6. Prices, Taxes & Payment

The price charged will be the price displayed for the selected artwork and dimensions at the time the order is submitted, subject to correction of material errors before acceptance.

Complimentary delivery is included to supported destinations when stated on the artwork page or at checkout. Applicable sales tax, value-added tax, customs duties, import charges, brokerage fees, or other government-imposed amounts may be added or assessed separately.

Unless expressly stated at checkout, import duties and destination-country charges are not included in the artwork price and remain the responsibility of the recipient.

You agree to provide valid and authorized payment information. Payment and installment services may be supplied by Shopify or other third-party payment providers and may be subject to their own terms, eligibility requirements, and privacy practices.

Currency conversions, card-provider charges, and foreign transaction fees are determined by the applicable financial institution and are not controlled by the House of Montague.


7. Made-to-Order Production, Changes & Cancellations

Each artwork is produced after the acquisition has been confirmed. Production may begin promptly following order confirmation.

If you need to request a change or cancellation, contact the House immediately. We will make reasonable efforts to assist before production begins; however, changes and cancellations cannot be guaranteed once the artwork has entered production.

Except where required by applicable law, made-to-order artworks are final sale and are not eligible for return, exchange, or refund solely because of a change of mind.

Damage, verified production defects, fulfillment errors, loss in transit, and circumstances in which mandatory consumer rights apply are governed by our Returns & Refunds Policy .


8. Production, Shipping & Delivery

Artwork production and delivery timeframes are estimates rather than guarantees. Current guidance is provided on the applicable artwork page and in our Shipping & Delivery Policy .

Delivery timing may vary according to artwork size, destination, customs processing, carrier conditions, severe weather, and circumstances outside our reasonable control.

If a material delay occurs, we will provide an updated estimate and any options required under applicable law. Expedited production or express delivery is not available unless expressly offered at checkout.

A complete residential or business street address is required. The collector is responsible for ensuring that the delivery name, address, email, and telephone information supplied with the order are accurate and complete. Address changes requested after production or dispatch begins cannot be guaranteed.

Risk of loss or damage remains with the House of Montague until the artwork has been delivered to the recipient or another person designated to receive it, except where applicable law provides otherwise or the collector independently appoints a carrier not offered through the Services.

Ownership of the physical artwork transfers upon receipt of full payment and delivery of the work. Ownership of the physical artwork does not include ownership of copyright or reproduction rights.


9. Damage, Defects, Fulfillment Errors & Loss

If an artwork arrives damaged, contains a verified production defect, differs materially from its confirmed description, or is received in an incorrect size or presentation, please contact us as soon as possible.

Where reasonably possible, the issue should be reported within 48 hours of delivery with photographs of the exterior packaging, shipping label, internal protective materials, artwork, and visible damage or discrepancy. The 48-hour reporting request helps us pursue transit and production claims efficiently but does not limit rights that cannot lawfully be excluded.

Because each artwork is made to order and individually registered, replacement is the standard remedy for verified damage, production defects, fulfillment errors, or confirmed loss in transit.

Refunds are not offered where a conforming replacement can be provided, except where required by applicable law or where replacement is unavailable. Complete requirements and procedures are stated in our Returns & Refunds Policy .


10. Intellectual Property & Copyright

The Services and their contents—including artworks, photographs, titles, collection narratives, written text, design studies, room imagery, graphics, logos, audio, music, video, animation, layout, and presentation—are owned by or licensed to TC Montague and are protected by applicable copyright, trademark, and other intellectual-property laws.

Acquiring a physical artwork grants ownership of that physical object only. Copyright and all reproduction, adaptation, publication, distribution, licensing, merchandising, synchronization, digital-display, and derivative rights remain with TC Montague unless transferred through a separate written agreement signed by the rights holder.

The owner of a physical artwork may display it in a private residence, collection, office, hospitality setting, or other interior environment. Acquisition does not authorize the artwork to be reproduced or used as advertising, branding, merchandise, packaging, publication content, digital assets, commercial décor reproductions, or training material for artificial intelligence or machine-learning systems.

Incidental photographs of an installed artwork for personal, non-commercial purposes are permitted, provided they do not function as substitutes for the artwork or misrepresent authorship.

Lawful transfer or resale of the physical artwork is not prohibited by these Terms. The Certificate of Authenticity should accompany any transfer. Requests to update the studio archive following a secondary transfer may be reviewed upon receipt of sufficient documentation but are not guaranteed.

“House of Montague,” “TC Montague,” associated logos, collection names, and other distinctive brand elements may not be used in a manner that suggests sponsorship, affiliation, endorsement, or authorization without prior written consent.


11. Permitted Use of the Services

The Services are provided for lawful personal, collector, editorial, and professional design-related use. You may view and use the Services for evaluating, discussing, or acquiring artwork.

You must not:

  • copy, reproduce, modify, publish, sell, distribute, or commercially exploit any part of the Services without written permission;
  • remove copyright, trademark, authorship, provenance, or rights-management information;
  • scrape, harvest, crawl, or systematically extract content or data from the Services;
  • use the Services or their contents to train, develop, evaluate, or improve artificial-intelligence or machine-learning systems without written authorization;
  • upload malware or interfere with the security, availability, or operation of the Services;
  • impersonate another person, submit false information, or engage in fraud;
  • use the Services to violate any law or the rights of another person; or
  • attempt to bypass access controls, payment systems, technical protections, or other security measures.

We may restrict or terminate access when we reasonably believe these Terms, applicable law, or the rights of the House or another person have been violated.


12. Third-Party Services, Tools & Links

The Services may provide access to tools, payment services, installment plans, applications, embedded content, or websites operated by third parties. These services are governed by the applicable third party’s own terms and privacy practices.

We do not control third-party websites and are not responsible for their content, availability, security, policies, or independent actions. Accessing or using third-party services is at your discretion.

Questions concerning a third party’s independent products or services should be directed to that provider. This does not affect obligations that the House of Montague has directly undertaken in connection with an accepted acquisition.


13. Relationship With Shopify

Shopify provides the ecommerce infrastructure that enables the Services. Purchases made through the House of Montague store are transactions directly between the collector and TC Montague.

Shopify is not the seller of the artwork and is not responsible for its authorship, production specifications, condition, delivery, authenticity, or the fulfillment of obligations undertaken by the House of Montague.

Shopify and its service providers may process information and payments as necessary to operate the commerce platform, subject to their applicable terms and privacy practices.


14. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy .

Because the Services are hosted by Shopify, information may also be collected or processed by Shopify and other service providers where necessary to operate the store, process payments, prevent fraud, fulfill orders, and provide related services.


15. Correspondence, Reviews & Submitted Material

If you voluntarily submit a review, testimonial, photograph, suggestion, comment, or other material for publication or promotional consideration, you represent that you have the right to provide it and that it does not violate another person’s copyright, trademark, privacy, publicity, or other rights.

Unless otherwise agreed in writing, you grant the House of Montague a non-exclusive, worldwide, royalty-free license to reproduce, edit, publish, and display material voluntarily submitted for publication in connection with the Services and the promotion of the House.

Private collector correspondence will not be treated as approved promotional material solely because it was sent to the House.

You must not submit unlawful, threatening, defamatory, abusive, obscene, misleading, infringing, or malicious content.


16. Errors, Inaccuracies & Availability

The Services may occasionally contain typographical errors, technical inaccuracies, omissions, or outdated information relating to artwork descriptions, dimensions, pricing, availability, production, delivery, or other details.

We may correct or update information at any time. If a material error affects an order before acceptance, we may request confirmation under the corrected terms or cancel the order and return any payment collected.

We may discontinue an artwork, dimension, material, feature, or service, subject to obligations arising from acquisitions already accepted.


17. Disclaimer of Warranties

Except for express commitments stated in these Terms, an applicable artwork listing, or an incorporated policy, the Services are provided on an “as available” basis to the fullest extent permitted by law.

We do not guarantee that website access will always be uninterrupted, secure, timely, or error-free, or that every technical defect will be corrected immediately.

Nothing in this section excludes an express artwork specification, the replacement commitments stated in our Returns & Refunds Policy, or a warranty or consumer right that cannot lawfully be excluded.


18. Limitation of Liability

To the fullest extent permitted by law, the House of Montague, TC Montague, and their service providers, contractors, licensors, representatives, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the Services or an acquisition, including loss of profit, revenue, business opportunity, data, or anticipated savings.

To the fullest extent permitted by law, total liability arising from a specific acquisition will not exceed the amount paid for that acquisition.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence, personal injury where exclusion is prohibited, or mandatory consumer protections.


19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TC Montague, the House of Montague, Shopify, and their respective affiliates, contractors, service providers, licensors, representatives, and agents from third-party claims, losses, and reasonable costs arising directly from:

  • your unlawful or unauthorized use of the Services;
  • your material breach of these Terms;
  • your infringement of another person’s rights; or
  • content or information knowingly submitted by you in violation of law.

This section does not require a consumer to indemnify a party for that party’s own negligence, misconduct, or breach of law.


20. Suspension & Termination

We may suspend or terminate access to the Services when reasonably necessary to protect the Services, prevent fraud or misuse, comply with law, or respond to a material breach of these Terms.

Termination of access does not affect rights or obligations arising from an accepted acquisition, amounts already due, intellectual-property ownership, or provisions that by their nature should continue after termination.


21. General Provisions

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions will continue in effect.

A failure or delay in enforcing a right does not waive that right. Any waiver must be stated in writing.

You may not assign your contractual rights or obligations under these Terms without prior written consent. We may assign these Terms in connection with a lawful transfer or reorganization of the business, provided that mandatory consumer rights are preserved.

These Terms and the policies incorporated by reference constitute the entire agreement concerning use of the Services and acquisitions made through them, except for any separate written agreement expressly entered into by the House and the collector.

Headings are provided for convenience and do not alter the meaning of these Terms.


22. Governing Law & Jurisdiction

These Terms and transactions with the House of Montague are governed by the laws of the State of Idaho and applicable federal law, without regard to conflict-of-law principles.

Subject to mandatory rights available to consumers in their jurisdiction, disputes that cannot be resolved informally will be brought in the state or federal courts serving Ada County, Idaho, and the parties consent to the jurisdiction of those courts.

Nothing in this section deprives a consumer of protections or access to a forum that cannot lawfully be waived under the laws applicable to that consumer.

23. Changes to These Terms

The most current version of these Terms will remain available on this page. We may revise these Terms to reflect changes in the Services, business practices, technology, or legal requirements.

Material changes will be communicated when required by law. Updated Terms become effective on the date stated in the revised version and will not alter rights arising from an acquisition already accepted except where required by law or agreed with the collector.
